Terms of Service

1. Acceptance of terms

By accessing or using Floowzy, you agree to these Terms of Service. If you are using Floowzy on behalf of an organization, you represent that you are authorized to accept these terms on its behalf.

2. The service

Floowzy is a SaaS platform provided by Floowzy Labs LLC for marketing analytics, reporting, dashboards, AI-assisted insights, alerts, and team collaboration. Floowzy also offers optional modules that act on your behalf only when you enable and configure them — including publishing or scheduling content to channels you connect, sending or assisting with replies to messages and comments, and creating advertising campaigns and budgets that you explicitly confirm. We may add, change, or remove features over time.

3. Accounts and workspaces

You are responsible for your account, your workspace, and the activity of team members and guests you invite. You must keep your credentials secure and provide accurate information.

4. Connected accounts and channels

Floowzy can connect to third-party advertising accounts, publishing channels, and messaging surfaces that you explicitly authorize. You are responsible for ensuring you have the right to connect those accounts and to access their data. Integrations are read-only unless you explicitly enable an action; we do not publish content, send messages, change, pause, or create campaigns without your explicit configuration and confirmation.

5. Subscriptions, billing, and cancellation

Paid plans are billed through third-party payment processors. Pricing may be offered as early access and may change before general availability. You can cancel according to our Refund and Cancellation Policy.

6. Acceptable use

You agree not to:

• Use the service unlawfully or in violation of any third-party platform's terms.
• Attempt to access data or accounts you are not authorized to access.
• Reverse engineer, disrupt, or overload the service.
• Upload, publish, or send malicious code, spam, or infringing content.

Your use of publishing, messaging, and advertising features is also governed by our Acceptable Use Policy.

7. No guarantee of advertising results

Floowzy provides analytics, reporting, and assistive insights. We do not guarantee any advertising outcomes, including sales, revenue, return on ad spend, conversions, or performance improvements.

8. AI-assisted content and insights

AI-assisted output — including insights, recommendations, captions, ad copy, and suggested message or comment replies — is generated automatically and provided “as is”. It may be incomplete, inaccurate, or unsuitable for your context. You are responsible for reviewing and editing AI-generated content before it is published or sent, and for any decisions you make based on it. We make no warranty as to the accuracy, fitness, or compliance of AI output. Where automated content is published or sent on your behalf, you remain responsible for it and, where applicable, for disclosing that it was generated or assisted by AI in line with platform rules and applicable law (including transparency expectations such as those in the EU AI Act).

9. Customer responsibility for content and messages

You are solely responsible for all content you publish and all messages, comments, and replies you send through Floowzy, including content that is scheduled, automated, or assisted by AI. You represent and warrant that you own or have all rights, licenses, and permissions necessary to publish that content and to send those communications, and that they do not infringe any third party's rights or violate any law or third-party platform policy. Floowzy acts on your instructions and configuration; you — not Floowzy — are the author and sender of that content for the purposes of platform rules and applicable law. We may refuse, suspend, throttle, or remove activity, and may suspend or terminate accounts, to address spam, abuse, security risks, or violations of these terms or of any connected platform's policies.

Where Floowzy processes personal data of your audience or contacts on your behalf (for example, messages, comments, or direct messages handled through the Inbox), that processing is governed by our Data Processing Addendum, and you act as the controller of that data.

10. Advertising campaigns and spend

When you use Floowzy to create or manage advertising campaigns, you authorize only the campaigns, budgets, and spend that you explicitly confirm. Advertising spend is charged by the relevant advertising platform under your own account and billing relationship with that platform, not by Floowzy. Floowzy is not liable for advertising spend or for advertising outcomes, including sales, revenue, return on ad spend, conversions, delivery, or performance. Any spend caps, limits, confirmation steps, or other safeguards Floowzy provides are a safety aid to help reduce the risk of error; they are not a guarantee, and you remain responsible for monitoring your campaigns and spend on each platform.

11. Automated and assisted messaging

If you use Floowzy to send or assist with replies to messages, comments, or direct messages, you must comply with the policies of each connected platform — including messaging windows, consent and opt-out requirements, rate limits, and prohibitions on spam or unsolicited messaging — as well as applicable communications and privacy laws. You are responsible for the audience you message and for ensuring you have a lawful basis to contact them. Floowzy is not responsible for messages you choose to send, and may limit or suspend automated or assisted messaging to protect platform integrity or to address abuse.

12. Third-party platforms

Floowzy is an independent platform and is not affiliated with, endorsed by, or partnered withMeta, Google, TikTok, LinkedIn, Pinterest, X, YouTube, Threads, Bluesky, Reddit, Telegram, Discord, or Google Business, or any other platform or channel, unless formally stated. All platform names and trademarks are the property of their respective owners. The availability of data, publishing, messaging, and advertising actions depends on each platform's APIs, the permissions you grant, your account settings, and each platform's policies, and may change over time. 13. Intellectual property

Floowzy and its software, design, and content are owned by Floowzy Labs LLC or its licensors. You retain ownership of content and files you upload; you grant us a limited license to host and process that content to provide the service.

14. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance and may suspend the service to protect its security or integrity.

15. Limitation of liability

To the maximum extent permitted by law, Floowzy Labs LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the service.

16. Termination

You may stop using Floowzy at any time. We may suspend or terminate access for violations of these terms or to protect the service or other users.

17. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-laws principles, unless updated by legal counsel.
